Divorce is often described using terms like “battle” and “contentious,” but things don’t have to be this way. Traditionally, divorce was resolved through litigation, which is not an appropriate venue for many couples who feel they can negotiate peacefully with one another.

Thankfully, alternatives to litigation are becoming commonplace, including divorce mediation. This is when a divorcing couple sits down with a neutral third-party mediator and negotiates the terms of their divorce and all aspects related to it. The mediator doesn’t make decisions or take sides. Instead, she or he keeps the discussion moving forward so that the two parties can reach their own agreement.

In addition to being a lawyer, I am also a certified mediator. In cases where I am not representing either client, I can be hired as a mediator (by the consent of both parties) or appointed to this role by the court.

Couples going through mediation are not required to have their own attorneys, but it is often a good idea to hire one because you can get case-specific guidance from someone who is primarily concerned with your best interests. When I am representing a client who is going through mediation, my role is to offer legal advice and support throughout the process.
